PERSONAL DATA PROTECTION REGULATION - provided pursuant to articles 13-14 of the GDPR (General Data Protection Regulation) 2016/679

Automazioni & Service s.r.l., with registered office in Via del Mare 19/E2 – 110040 Piobesi Torinese (TO), VAT and Tax ID 11799730012, in the name of its pro tempore legal representative, hereinafter referred to as the Data Controller, hereby informs users, pursuant to Art. 13-14 EU Reg. n.2016 /679, hereinafter GDPR, that, for the purposes of establishing and executing ongoing contractual relationships, our organization has in its possession user’s personal data, acquired even verbally, directly or via third parties, which are qualified as such by the Europe Regulation 2016/679 from (GDPR).

As per the indicated legislation, such treatment shall be characterised by the principles of correctness, lawfulness, transparency and protection of user’s privacy and rights.

Pursuant to Article 13 of the GDPR 2016/679, we hereby communicate the following information:

Type of data processed

Personal, fiscal and economic data required for the execution of contractual relationships, existing or future, with User’s company, as well as to effectively conduct business relations will be processed.

Data processed without your express consent (art. 24 lett. a, b, c Privacy Code and art. 6 lett. b, e GDPR), shall be used exclusively for the following Services:

  • to comply with pre-contractual, contractual and fiscal obligations related to existing relations with the Client;
  • to fulfil obligations foreseen by the law, regulations, EU legislation or by an Authority decree;
  • for the management of the technical support services related to sold products;
  • for the management of external working relations;
  • to execute the rights of the Data Controller; as an example, the right of legal defence;
  • for any other operational and operational requirements.

 

Only subject to specific and individual consent (art. 23 and 130 Privacy Code and art. 7 GDPR), for the following Additional Purposes:

  • remote access for training and / or assistance;
  • mailing of notices and/or newsletters via e-mail related to existing service contracts with the Client.

We do not possess any data of a special or judicial nature (Articles 9 and 10 of the GDPR).

Navigation data: IT systems and programs used to operate the site collect certain personal data, the transmission of which is implicit in the use of Internet communication protocols (e.g. IP addresses or domain names of computers used by users connecting to the site, URI – Uniform Resource Identifier – addresses of the resources requested, time of the request, method used to submit the request to the server, size of the file obtained in response, numerical code regarding the status of the response from the server – successful, error, etc. – and any other parameters relating to the operating system and the user’s IT environment). While such information has not been obtained for the purposes of being associated with identified interested parties, due to its very nature it could, via elaboration and association of data held by third parties, shall enable users to be identified.

Said data shall be used for the sole purpose of obtaining statistical information which is not directly related to any user identity data on the use of the website and in order to ensure its correct functioning and shall be deleted immediately after processing. Data may be used to determine responsibility in case of possible computer crimes against the Site.

Purpose of the treatment and duration

Collected data will be processed for the entire duration of contractual agreements and thereafter, for contractual requirements and related legal and fiscal obligations, and for the effective management of financial and commercial dealings as well as operations indicated in art. 4 Privacy Code and art. 4 n. 2) GDPR. The Data Controller shall process personal data for the time necessary to fulfil the aforementioned purposes and in any case for no longer than 10 years from the termination of the Service Agreement.

 

Processing procedures:

Processing will be carried out manually and/or electronically with organization and processing methods strictly related to the purposes of said data and, in any case, in such a way as to guarantee the security, integrity and confidentiality of the data in compliance with organisational, physical and logical procedures foreseen by current regulations.

 

Obligation or authority to provide data:

Users may choose to provide their data. With regard to the data we are obliged to collect so as to comply with any legal demands, failure to provide such data implies the impossibility of initiating or maintaining any such business dealings, to the extent that such data is necessary for the execution of the same.

 

Reasons for your data:

The following categories of persons may come into contact with such data in their capacity as data processors or persons in charge of processing, appointed by the undersigned company and data controller: managers, directors and auditors; internal administrative offices; accounting and invoicing staff; service marketing staff; sales agents and representatives.

 

Disclosure and dissemination:

Notwithstanding any disclosure and diffusion which my have been executed in compliance with the Law, all data collected and processed may be disclosed to credit institutions for the management of collections and payments, financial institutions, insurance companies and auditors; to employees or collaborators; to external parties who perform functions related to the execution of the contract (shippers, licensed suppliers, etc…) in addition to third parties. Any disclosure and diffusion of such data is strictly related to the execution of the Company’s own commercial operations. The data may also be disclosed and distributed abroad, in compliance with applicable Laws.

 

Rights of User:

As data subject, users may exercise their rights under Art. 7 of the Privacy Code and Art. 15 GDPR and specifically the rights to: i. obtain confirmation of the existence or otherwise of personal data related to the same, even if not yet recorded, and disclosure thereof in a legible format; ii. obtain information about: a) the source of personal data; b) the reasons and methods of treatment; c) the logic applied if processing is carried out electronically; d) the identity of the data controller, processors and appointed persons as per art. 5, paragraph 2 Privacy Code and art. 3, paragraph 1, GDPR; e) the subjects or categories of subjects to whom the personal data may be disclosed or who can become aware of such data as appointed persons within the Country, processors or appointed persons; iii. obtain: a) updates, corrections or additions to the data; b) deletion, conversion into anonymous form or suspension of data processed in violation of the law, including data whose retention is not necessary in relation to the purposes for which the data has been collected or subsequently processed; c) proof that such operations, including their content, have been brought to the attention of those to whom the data has been disclosed or divulged, except where this proves impossible or involves the use of means clearly excessive in relation to safeguarding such right; iv. object, in whole or in part: a) for legitimate reasons the processing of any personal data related to user, even if pertinent to the objective of said collection; b) the processing of personal data related to user for the purpose of sending advertising material or direct sales or for conducting market research or sending out advertising information, by employing automated calling systems without the intervention of an operator via email and/or traditional marketing methods via telephone and/or printed material.

Where applicable, users may also exercise certain rights set forth in Articles 16-21 GDPR (Right to Rectify, Right to Be Forgotten, Right to Restriction of Processing, Right to Data Portability, Right to Object), as well as the right to lodge a complaint with Data Protection Authorities. At any moment, users may obtain proof of the existence or otherwise of personal data concerning them, as well as the disclosure of said data and the purposes on which processing is based. In addition, users may cancel, anonymously transform or block data processed in violation of the law, as well as update, rectify or, if user should have an interest, complete such data. Users may oppose, for legitimate reasons, the processing of data.

In order for us to comply with art. 11, letter (c) of the above-mentioned regulation, please promptly inform us of any changes affecting your personal data. The said article requires that all data collected be accurate and up-to-date.
